BLOOMING PARTY RENTALS TERMS AND CONDITIONS OF RENTAL
Important Notice: By accessing our website, requesting a quote, or accepting delivery/pickup
of any rental equipment from Blooming Party Rentals (“Company”), you (“Customer”) agree to be bound by the following Terms and Conditions. Please read them carefully before finalizing your booking.
If any provision of this Agreement is determined to be unenforceable, the remaining provisions shall remain in full force and effect.
These Terms and Conditions constitute the entire agreement between the parties and supersede any prior verbal or written agreements. Acceptance of an online quote, payment of any deposit, electronic signature, or acceptance of delivery constitutes agreement to these Terms and Conditions.
1. Rental Period/Return Policy
● Rental Period: The rental period begins upon delivery (or pickup by the Customer) and
ends at the scheduled pickup time listed on the rental agreement. Equipment not
available for pickup at the scheduled time may incur additional daily rental charges.
● Late Return Fee: Equipment not available at the scheduled pickup time may be subject
to an additional rental fee equal to one full day's rental for each additional day, plus any
recovery costs.
2. Booking, Security Deposits, and Payments
● Security Deposit: To reserve rental equipment and hold an event date, customer must
pay a refundable security deposit of $25.00 to $50.00 (depending on order size) at the
time of booking.
● Final Payment: The remaining final balance of the rental fee is due in full at the time of
delivery (or at the time of pickup, if the Customer has opted for self-pickup).
● Payment disputes: Customer agrees not to dispute valid charges for damages,
replacement costs, or unpaid rental fees when documented by Company.
● Card on File Authorization: Customer must provide a valid credit or debit card at the time
of booking. Customer explicitly authorizes the Company to keep this card on file and to charge it for any final balances, missing items, unreturned equipment, or major damage
as outlined in Section 4.
● Refusal to pay: In the event Customer refuses to pay, the Customer agrees to reimburse
Company for reasonable collection costs, court costs, and attorney's fees incurred in
collecting unpaid amounts where permitted by law.
3. Cancellation and Weather Policy
● 48-Hour Window: Customer may cancel their reservation up to forty-eight (48) hours
prior to the scheduled event date to receive a full refund of their security deposit.
● Late Cancellations and No-Shows: If a cancellation is made less than 48 hours before
the event, or if the Customer is a "no-show" on the day of the rental, the security deposit
is strictly non-refundable.
● Weather Conditions: Weather-related cancellations are at the sole discretion of the
Customer. If the Customer wishes to cancel an event due to rain, high winds, extreme
heat, or other predicted inclement weather, they must do so at least forty-eight (48)
hours before the event to save their deposit. Cancellations due to weather within the
48-hour window will result in the forfeiture of the security deposit. Equipment must not be
used in unsafe weather conditions including but not limited to high winds, lightning,
heavy rain, or flooding.
● Force Majuere: in the event of an unpredictable force majuere neither party shall be held
liable and customer will be issued a refund on any unfulfilled obligations. In the event
that rental equipment in the customers care all damages and loss may result in loss of
deposit or compensation for such items
● Weather Damage: Customer assumes all responsibility for protecting rental equipment
from rain, excessive wind, flooding, fire, and other weather-related damage while
equipment is in their possession.
4. Delivery, Self-Pickup, and No-Setup Policy
● Delivery Boundaries: Company provides delivery to the front door/driveway only.
Delivery personnel will not transport equipment to backyards, inside homes, up flights of
stairs, or through difficult or obstructed paths.
● Delivery Delays: Company shall not be liable for delays caused by traffic, accidents,
severe weather, road closures, or circumstances beyond Company's reasonable control.
● Customer Presence & Access: Customer (someone 18 years or older) must be
physically present at the time of delivery or pickup. Customer must ensure a clear, safe,
and unobstructed path is available for the delivery vehicle and personnel.
● Strict No-Setup Policy: Blooming Party Rentals does not offer setup or teardown
services. Customer is entirely responsible for setting up, breaking down, and re-packing
all rented equipment. All items must be broken down and returned to the front door/designated drop-off point in the same manner they were received by the scheduled
pickup time.
● Delivery Refusal: Company reserves the right to refuse delivery. Such refusal does not
entitle Customer to a refund if refusal was due to unsafe conditions caused by Customer.
Reasons for delivery refusal can include but are not limited to:
● Aggressive pets
● Unsafe driveway
● Customer seeming high or drunk during delivery
● Impossible access
● Aggressive behavior
● Weather conditions
5. Equipment Cleanliness, Loss, and Damage
● Cleanliness & Stains: All rental equipment must be returned in a clean condition. If
equipment is returned with permanent stains, or hard-to-clean stains including, but not
limited to, paint, heavy grease, marker, or substances requiring specialized or excessive
cleaning. Equipment returned excessively dirty may incur reasonable cleaning charges
in addition to forfeiture of the security deposit if applicable. Some cleaning fees may
exceed $50.
● Missing Items: Customer is responsible for the safekeeping of all items while in their
possession. In the event of missing or unreturned items (including, but not limited to,
tables, chairs, or machine components), Company will charge the credit card on file for
the full retail replacement cost of the missing equipment.
● Theft: Customer is responsible for theft, vandalism, or loss of equipment during the
rental period regardless of fault.
● Major Damage: If any equipment is broken, structurally compromised, or ruined during
the rental period, Customer will be held financially responsible. Company will charge the
card on file for the total cost of repairing or replacing the damaged equipment.
6. Assumption of Risk and Liability (Hold Harmless)
● Limitation of liability: Company's liability shall be limited to the amount paid for the rental.
Company shall not be liable for indirect, incidental, consequential, or special damages
arising from the rental.
● Equipment failure: If equipment becomes inoperable due to normal mechanical failure,
Company's sole obligation shall be to repair, replace, or refund the affected rental item if
a replacement is unavailable.
● Customer inspection: Customer agrees to inspect all equipment upon delivery and notify
Company immediately of any shortages or damage. Failure to report issues upon
delivery constitutes acceptance of the equipment in good condition.
● Photo documentation: Company reserves the right to photograph equipment before
delivery and after pickup to document condition.
● Customer Responsibility: Because Customer is solely responsible for the assembly,
installation, utilization, and disassembly of all rented equipment (including tents, tables,
chairs, and machinery), Customer assumes all risks associated with the use of the
equipment.
● Underground utilities: Customer is responsible for identifying underground utilities before
any staking.
● Indemnification: Customer agrees to defend, indemnify, and hold harmless Blooming
Party Rentals, its owners, employees, and agents from and against any and all claims,
liabilities, damages, losses, costs, or injuries (including severe injury or death) arising out
of or related to the delivery, setup, use, misuse, collapse, malfunction, or breakdown of
the rented equipment while in the Customer's possession.
● Misuse of equipment: Customer agrees not to:
○ stand on tables
○ stand on chairs
○ drag tables/chairs across concrete
○ modify equipment
○ paint equipment
○ tape decorations that leave residue
○ use equipment for commercial construction
○ overload tables
Any injuries or damages resulting from misuse of equipment are at the sole responsibility of the
customer and may result in loss of deposit and full reimbursement of the retail cost to repair and/or replace equipment
7. Media and marketing
● Photography: Company may photograph rental equipment at events for promotional
purposes provided no identifiable individuals are featured without permission.
Governing Law
● These Terms and Conditions shall be governed by, construed, and enforced in
accordance with the laws of the State of Texas. Any legal actions, disputes, or mediation
arising out of this agreement must be filed and settled in the court of proper jurisdiction
closest to the Company's primary operating location in Texas
